H0039: Refusal to Submit to Breath, Urine, or Blood Test

Legislative Summary

Requires person arrested for DUI who refuses to submit to lawful breath test to be told that he or she is subject to mandatory placement of ignition interlock device on all vehicles leased or owned & routinely operated by person; requires person arrested for DUI who refuses to submit to lawful breath test to be subject to mandatory placement of such device on all vehicles leased or owned & routinely operated by person; authorizes certain placement periods to run concurrently; requires reporting to DHSMV; requires certain information to be contained in notice of suspension; waives requirement to install such device; directs DHSMV to require placement of such device before issuing permanent or restricted driver license to person who refused to submit to lawful breath test; requires person to install device at his or her own expense for specified period.
