Legislative Summary

Provides exception to application of certain provisions of Workers' Compensation Law; specifies how employer may elect to secure payment of compensation; authorizes employee of qualified compensation alternative (QCARE) employer to bring certain cause of action; provides that QCARE employer is entitled to offset to occupational injury benefits paid to & on behalf of employees; requires QCARE employer to adopt written occupational injury benefit plan; prohibits QCARE employer from charging fee, premium, or other similar cost to covered employee for occupational injury benefit plan; authorizes QCARE employer to select or authorize medical providers; requires QCARE employer to demonstrate financial responsibility; authorizes such employer to self-fund or insure benefits & liabilities under its occupational injury benefit plan; provides that all benefit payments by qualified compensation arrangement employer are made pursuant to Workers' Compensation Law.
