Amend KRS 224.16-050 to require the Energy and Environment Cabinet to update and study the state assumption of the Section 404 permitting program; authorize the Governor to seek assumption; if the United States Environmental Protection Agency grants the delegation to the state, ensure the permitting process reduces duplication, streamlines the process for coal companies, and ensures permits are issued in a fair and equitable manner; require the cabinet to implement an online portal for the processing of permits issued, including the Section 404, Section 402 and Section 401 certification; require the portal to provide a flow chart of each permit process with timelines; require the portal to show when an application is complete and the expectation on when a final decision is made; restrict access to the information in the application from open records or public access; reduce the application fee for a permit that has been mishandled or delayed by the cabinet.
