Legislative Summary

An Act To Provide For The Licensure And Regulation Of Adult Residential Treatment Facilities And Adult Supportive Residential Facilities By The State Department Of Mental Health; To Direct The State Board Of Mental Health To Adopt Rules Providing For Facility Requirements And Minimum Programmatic, Staffing And Operational Requirements Of Services Offered At The Facilities; To Provide That It Is Unlawful For Any Person, Partnership, Association, Corporation Or Other Entity To Own Or Operate An Adult Mental Health Facility Without Having Applied For And Obtained A License From The Department; To Amend Section 43-13-117, Mississippi Code Of 1972, To Provide That Mental Health Services Provided By Adult Residential Treatment Facilities And Adult Supportive Residential Facilities Shall Be Covered Under The Medicaid Program; To Prescribe The Initial Fee Schedules For The Four Levels Of Care Provided In Those Facilities; To Direct The Division Of Medicaid To Apply For A Federal Waiver As Necessary To Allow For The Implementation Of The Provisions Of This Act; To Extend The Date Of The Repealer On That Section; And For Related Purposes.
